Grind Logic operates this store and website, including all related information, content, features, tools, products and services in order to provide you, the customer, with a curated shopping experience (the “Services”). Grind Logic is powered by Shopify, which enables us to provide the Services to you.

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.
You are entitled to:
· A replacement or refund for a major failure, and
· Compensation for reasonably foreseeable loss or damage.
· You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

By agreeing to these Terms, you confirm you are at least 18 years of age, or have obtained parental/guardian consent to use the Services. You agree not to use our products for any illegal or unauthorised purpose or violate any laws in your jurisdiction (including but not limited to copyright laws).
You must not transmit any worms or viruses or any code of a destructive nature.
Any breach or violation of any of these terms will result in an immediate termination of your access to our services.
SECTION 2 - OUR PRODUCTS
We have made every effort to provide an accurate representation of our products and services in our online stores. However, please note that colors or product appearance may differ from how they may appear on your screen due to the type of device you use to access the store and your device settings and configuration.
We do not warrant that the appearance or quality of any products or services purchased by you will meet your expectations or be the same as depicted or rendered in our online stores.
All descriptions of products are subject to change at any time without notice at our sole discretion. We reserve the right to discontinue any product at any time and may limit the quantities of any products that we offer to any person, geographic region or jurisdiction, on a case-by-case basis.

Some products or services may be available exclusively online through the website. These products or services may have limited quantities and are subject to return or exchange in accordance with our Refund Policy and your rights under Australian Consumer Law.
We endeavour to ensure product descriptions and images are accurate, but we do not warrant that all descriptions are error-free.

- Limit the sale of our products or services to any person, geographic region, or jurisdiction (on a case-by-case basis),
- Limit the quantities of any products or services offered,

All prices and product descriptions are subject to change at our sole discretion. Any offers for products or services on this site are void where prohibited.

SECTION 6 – PRICING, BILLING & ORDER ACCURACY
We aim to provide accurate product and pricing information but do not warrant that all content is error-free. Prices are subject to change without notice, and we may correct any errors, inaccuracies, or omissions at any time, including after an order has been placed.
We reserve the right to:
- limit sales of our products,
- discontinue products without notice,
- change pricing at any time.
These limits may apply to orders placed under the same customer account, payment method, billing address, or shipping address. If we cancel or adjust your order, we may attempt to notify you using the email or phone number provided at checkout.
You agree to provide accurate, complete, and up-to-date purchase and account information for all transactions made on our site. This includes promptly updating your email address, billing details, and payment information, so we can complete your order and communicate with you effectively.
SECTION 7 – RETURNS, REFUNDS, AND CANCELLATIONS
All conditions of refunds and returns are additional to your rights under Australian Consumer Law. You may return new, unused items within 60 days of delivery for a full refund. Used items may be returned within 60 days for change-of-mind, subject to inspection and a restocking fee of up to 15%. Customers are responsible for return shipping on change of mind returns. This does not apply to faulty or incorrect items, which remain covered under the Australian Consumer Law. Faulty or incorrect products are eligible for a repair, replacement, or refund in line with your rights under the Australian Consumer Law. We cover return shipping for faulty or incorrect items.
Unless required under Australian Consumer Law, the following items are non-refundable: consumables, parts (e.g. burrs), coffee, certified open box items, and clearance/final sale products. If coffee was included as a gift, its value will be deducted from any refund.
All products include a 1-year manufacturer’s warranty covering defects under normal home use. This warranty does not cover consumables or misuse. This warranty operates alongside to your rights under Australian Consumer Law.

Orders may be cancelled by the customer prior to dispatch by contacting us at info@grindlogic.com.au. We reserve the right to cancel orders where a product is no longer available or has been listed with an error in pricing or description
SECTION 8 – THIRD-PARTY TOOLS, AND THIRD-PARTY LINKS
We may offer tools or links to third-party sites. Use of these is at your own risk, and we are not liable for any third-party services, content, or transactions.
You acknowledge and agree that we provide access to such tools “as is” and “as available” without any warranties, representations or conditions of any kind and without any endorsement. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools. Any use by you of the optional tools offered through the site is entirely at your own risk and discretion and you should ensure that you are familiar with and approve of the terms on which tools are provided by the relevant third-party provider(s).

All personal information we collect through the Services is subject to our Privacy Policy, which can be viewed here, and certain personal information may be subject to Shopify’s Privacy Policy, which can be viewed here which complies with the Privacy Act 1988 (Cth). By using the Services, you acknowledge that you have read these privacy policies.
Because the Services are hosted by Shopify, Shopify collects and processes personal information about your access to and use of the Services in order to provide and improve the Services for you. Information you submit to the Services will be transmitted to and shared with Shopify as well as third parties that may be located in other countries than where you reside, in order to provide services to you. Your data may be stored or processed on servers located outside Australia, including in Canada, the United States, or other jurisdictions, as required for Shopify’s operation of the platform. SECTION 10 - SHIPPING AND DELIVERY
We are not liable for shipping and delivery delays. All delivery times are estimates only and are not guaranteed. We are not responsible for delays caused by shipping carriers, customs processing, or events outside our control. Title to goods passes to you upon full payment. Risk of loss or damage passes upon delivery, except where otherwise required under Australian Consumer Law.
SECTION 10A – INTERNATIONAL ORDERS
a) Import Duties and Taxes: International customers are responsible for any applicable import duties, taxes, customs fees, or other charges imposed by their country of residence. These charges are not included in our product or shipping prices and may be collected by your local customs authority upon delivery. We are not responsible for delays caused by customs processing or the refusal of your local customs agency to release the package.
b) Shipping Times: International delivery times are estimates only and may vary due to customs delays, weather, courier issues, or other factors beyond our control. We do not guarantee delivery dates for international orders.
c) Risk of Loss and Title: Risk of loss or damage to items passes to you upon our delivery to the international carrier, except where otherwise required by Australian Consumer Law. Title to the goods transfers to you upon shipment.
d) Return and Warranty Limitations: We do not offer change-of-mind returns for international orders unless otherwise stated or required by law.
e) You may still be entitled to a repair, refund, or replacement under Australian Consumer Law if the product is faulty, even if purchased internationally. However, shipping costs for warranty claims outside Australia may be your responsibility unless otherwise agreed or required by law.
f) Local Law Compliance: You are responsible for ensuring that the purchase, import, and use of our products comply with all laws and regulations in your country.
g) Currency and Conversion Fees: All transactions are processed in Australian Dollars (AUD). Your bank or payment provider may charge conversion fees or apply a different exchange rate, for which we are not responsible.
SECTION 11 - INTELLECTUAL PROPERTY
Our services, including but not limited to all trademarks, brands, text, displays, images, graphics, product reviews, video, and audio, and the design, selection, and arrangement thereof, are owned by Grind Logic, its affiliates or licensors and are protected by U.S. and foreign patent, copyright and other intellectual property laws.
These Terms permit you to use the Services for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on the Services without our prior written consent. Except as expressly provided herein, nothing in these Terms grants or shall be construed as granting a license or other rights to you under any patent, trademark, copyright, or other intellectual property of Grind Logic, Shopify or any third party. Unauthorized use of the Services may be a violation of federal and state intellectual property laws. All rights not expressly granted herein are reserved by Grind Logic.
Grind Logic’s names, logos, product and service names, designs, and slogans are trademarks of Grind Logic or its affiliates or licensors. You must not use such trademarks without the prior written permission of Grind Logic. Shopify’s name, logo, product and service names, designs and slogans are trademarks of Shopify. All other names, logos, product and service names, designs, and slogans on the Services are the trademarks of their respective owners.

If you submit, upload, post, email, or otherwise transmit any ideas, suggestions, feedback, reviews, proposals, plans, or other content (collectively, “Feedback”), you grant us a perpetual, worldwide, sublicensable, royalty-free license to use, reproduce, modify, publish, distribute and display such Feedback in any medium for any purpose, including for commercial use. Nothing in these Terms of Service excludes, restricts or modifies any consumer guarantee, right or remedy conferred by the Australian Consumer Law or any other applicable law that cannot be excluded, restricted or modified by agreement. To the maximum extent permitted by law, Grind Logic, its officers, employees, contractors and agents will not be liable for any indirect, incidental, special or consequential loss, including loss of profits or data, arising out of or in connection with your use of the services or any products purchased, except where such loss is caused by our negligence, breach of contract, or breach of a non-excludable consumer guarantee under the Australian Consumer Law.
SECTION 17 - INDEMNIFICATION
You agree to indemnify, defend and hold harmless Grind Logic, Shopify, and our affiliates, partners, officers, directors, employees, agents, contractors, licensors, and service providers from any losses, damages, liabilities or claims, including reasonable attorneys’ fees, payable to any third party due to or arising out of (1) your breach of these Terms of Service or the documents they incorporate by reference, (2) your violation of any law or the rights of a third party, or (3) your access to and use of the Services.
We will notify you of any indemnifiable claim, provided that a failure to promptly notify will not relieve you of your obligations unless you are materially prejudiced. We may control the defense and settlement of such claim at your expense, including choice of counsel, but will not settle any claim requiring non-monetary obligations from you without your consent (not to be unreasonably withheld). You will cooperate in the defense of indemnified claims, including by providing relevant documents.
